At CDLA Abogados, we are pleased to share our participation in the annual magazine of Prestige Properties Ibiza, a leading publication for homeowners, buyers, and investors interested in Ibiza’s real estate market.
We contributed a legal article on an urban planning concept that is particularly relevant in the Balearic Islands: the legal status known as “out of planning” (“fuera de ordenación”).
This is an issue that raises many questions among both international buyers and property owners in Ibiza, especially when dealing with older properties, extensions carried out years ago, or homes located on rustic land.

What Does “Out of Planning” Really Mean?
Generally speaking, a property is considered “out of planning” when, although it was legally built or any potential urban planning infringement is now time-barred, it no longer fully complies with current urban planning regulations.
This may occur, for example, when:
Urban planning regulations change after the property was built.
There are extensions or elements that cannot be legalised.
The plot no longer complies with current planning parameters.
The property is in a tolerated urban planning situation but subject to limitations.
It is important to understand that being “out of planning” does not necessarily mean that the property is illegal or cannot be sold, but it may
involve certain significant restrictions.
What Are the Possible Implications?
Depending on the type and degree of the “out of planning” status, restrictions may apply to:
Extension or renovation works.
Partial or total reconstruction.
Obtaining certain licences.
Future development or subdivision possibilities.
Bank valuations or mortgage financing.
For this reason, carrying out a complete urban planning due diligence before purchasing a property in Ibiza is essential.
